First Time Offenders with low BAC
First time DUI offenders with a low Blood Alcohol Content are not charged with any penalties or jail time in Wyoming. However, the offender is put on a one time diversion program called “Probation Before Sentencing” for 6 months during which the offender must participate in an alcohol education and treatment program. Once the probation period is complete, the conviction is removed from the offenders record. However, the probation option is only available to first time offenders.
Like in other states of America, the legal threshold for Blood Alcohol Content (BAC) in Wyoming is also set to 0.08% and amounts equal or higher than 0.08 are charged with DUI. For drivers under the age of 21 years, the State of Wyoming has a lower BAC limit of 0.02% and 0.04% for commercial drivers.
First Time DUI Offenders
First time offenders are fined up to $750 and can be jailed up to a period of 6 months, along with 90 days license suspension.
Second Time DUI Offenders
Second time offenders are fined a minimum of $250 up to $750 along with minimum 7 days jail up to 6 months. The offenders driver’s license is suspended for 1 year, followed by installation of an ignition interlock device for 1 year.
Third Time Wyoming DUI Offenders
Third time offenders are charged anywhere between $750 up to $3000 and jailed between 30 days up to 6 months. The offenders driver’s license is suspended for 3 years, followed by installation of an ignition interlock device for 2 years.
Fourth Time Wyoming DUI Offenders
A fourth DUI offense within a 5 years period of a previous conviction in considered a felony in the State of Wyoming and is fined up to $10000, with prison sentence of up to 2 years. The driver’s license is suspended, and may be renewed after 5 years, after which the offender has to use a mandatory ignition interlock device.
In some cases, the offenders may have to go through an Inpatient Treatment Program, Substance Abuse Assessment or an Alcohol Education Program, depending on the courts decision.
Offenders with BAC of more than 0.15 have to install an ignition interlock device once the license suspension is revoked. This applies to any occurrence of a DUI offense in Wyoming.
