First offense, i see that there is a minimum of 2 days in jail but im worried because the day after my court, i have a meeting at work thats mandatory... is there any way to choose the days? i was wondering if theres any way to possibly get no jail time.

pulled over with expired plate. Officer said he smelled marijuana, didn't know passenger had drugs on her/him. Officer let passenger go when she said the small amount of drugs were not hers. He then proceeded to ask me to step out of the car. Said I failed the field sobriety test. Placed me under arrest. I cooperated, and was released and told I would receive a court date in the mail. I have Bi Polar II and severe anxiety. I had not consumed marijuana, my breathalizer test came back as 0.000. I have never been pulled over, or broken any law ever. I was unaware my plates had expired.

I plead guilty to a dui. Now dealing with the WEst VIrginia DMV. I now live in Virginia, but west virginia says I need to complete the interlock program. THey say the only way to enroll in the interlock program is to be a citizen of WEst Virginia and have an address which I am unable to do. WOndering how I can get a license in Virginia and still make West Virginia happy. This makes no sense to me.

I am a juvenille that is 17 and turns 18 in may..i have been in and out of juvenille placements...I was told next time i get in trouble i could be charged as an adult...I got a public intox which means as a juvenille ill be put away until may...where as if i asked to be tried as an adult for 1st offense i would get a fine and only a fine..would that be reccomended?

I had been fishing and my hand is in a splint. i took a hydrocodone for pain. it still hurt. the other people were drinking and one said, drink a couple beers and it will stop hurting. i drank 2 beers and we left about 40 min. later. my friend put another beer in a cup for me. i went to kroger,s and bought deli chicken and ate a leg and drank a couple drinks and pulled out of kroger's. the officer pulled me over because of loud exhaust. i told him what i drank. he did the hand held intoxilyzer and made me do different tests. i stood on one leg for 15 sec. at least, then he said, i said 6 in., not 12. i was stll standing and i lowered my leg again. he said i failed all the tests. he told me to blow the bigger machine and i wouldn't because i can't read without readers. i later read my papers in jail. he wrote down the wrong type vehicle and has on letter off my plate incorrect. i had to call him after i got out of jail because he kept my insurance paper and registration card. theymailed them back to me. he told me he thought i drink everyday and said he could check by putting things on my fingers. i told him to do it but, he didn,t. he towed my truck and let my granddaughter drive from a little store upon which she could have gotten caught without the ins. and registration.he did't like me because i had had other dui's. the last being in 99.

Does the arresting officer have to appear in court? And if so does he have to work for the same Department? He was a Hinton city police officer and quit there. But now has moved to the Summers County Sheriff s Department which is the same County. And would it matter if he did show up to court for my charges?

The arresting officer has informed me that he has switched jobs. He was a Hinton city police officer at the time of the arrest and now he has moved to the County Sherrifs Dept. ! Is or could that make the case against me not valid? Some one told me that he has to be present in the court or it would not be legal! But I wanted to know if he is present but not working for the "city" police would the case be dismissed or what?
