Washington DUI Penalties for BAC below 0.15
First time offenders: First time offenders are charged a fine anywhere between $100 up to $500 and can be jailed up to 6 months. If a minor under the age is found in the vehicle at the time of arrest, the offender will have to serve anywhere between 2 days to 12 months in prison. The offenders driver’s license is also suspended for 15 days.
Second time offenders: Second time offenders are charged fines between $1000 up to $3000 and are jailed for a minimum of 6 months up to 12 months. The offenders drivers license is suspended for 1 year followed by installation of an ignition interlock device.
Third time offenders: A third time conviction for drunk driving is considered a felony in the state of West Virginia. 3rd time WV DUI offenders are fined between $3000 up to $5000 and jailed for a minimum of 1 year up to 3 years. The driver’s license is suspended for 1 year, followed by installation of an ignition interlock device.
Washington DUI Penalties for BAC above 0.15
First time offenders: First time offenders with BAC above 0.15% are fined between $100 up to $1000 and jailed for a minimum of 2 days up to 6 months. In this case, the driver’s license is suspended for 45 days and has to be followed by possible installation of an ignition interlock device. They are also confined to jail for another minimum of 5 days, and 10 days in case BAC is more than 0.20%.
Second time offenders: Second time offenders are confined to jail for another minimum of 10 days and another minimum mandatory of 20 days for BAC more than 0.20%.
