pulled over for speeding and given a warning. Then given a PBT, then a full field sobriety test set, then a second PBT. According to second pbt, .117% BAC. Arrested for dwi, then released on personal recognizance. Have court on 10/4/2011 and looking for advice.

My cousin was at a party he is only 19. When the police pulled up he had a beer in his hand. The cop put him in the cop car and then entered the house. After letting everyone else leave without issuing any minors he came back out to my cousin. He told him he had to take the breathalyzer test. When my cousin asked if he absolutely had too the cop said yes. I am in class for law enforcement and they have told us that you can refuse it. Did this officer violate his rights by lying and forcing him to take it. He also made him take it three times because supposedly the first two times it didn't work. The third time it did. However he didn't write the results on the ticket or tell my cousin. should he get the report and see if he wrote it on there? Just trying to find out for him if this is even worth pursuing.

Was caught for speeding doing a 57 in a 45. Officer after talking to me asked if I had been drinking. I had not in the past 7.5 hours, but had been drinking the night before and stopped at 1am (time arrested was 9:30am the following morning). I thought that amount of time would have been sufficient to drive as I felt ok the next morning.

driving a mark car that police been pulling over continuesly, Did a 3 to 5 sec yeild at a stop sign, making a right turn using signal right turn with no coming traffics at all at the intersection. Pulled into the gas station, shut off car keys in ignition. saw two police cars pulled up behind and ask for registration and insurance. i cooperate with officers and did a physical test to see if i was drunk i pass. i got put in hand cuffs and place under arrest without my rights being read. then i breathalize at .170 iI was booked and got dna including blood drawn, I never got results. i got my first dui in Wisconsin and 3 years later was citation for a traffic violation. one of the citation is written was O.A.R- 1st offense ( OWI Related). in that state of Wisconsin a fisrt dui is not a criminal charge. this is my 1st in Huron, SD.

I was speeding on I-29. Officer said I was going 112mph. I don't believe that. I was speeding but, not 112, maybe 90 mph. I did the field test and sobriety test and registered 0.22. I was taken to jail, mug shot, blood work taken, and fingerprinted. I live in Tennessee and are working in Brookings for FEMA. This is my first offense. What are your charges for representation and what are my options. Thanks

I was in Lennox at the car show. We staye after the show to listen to a band. I had two beers and then we were going to all go home. I went to the bathroom before we left. I went to go meet my friends that I was with as we had someone coming to get us. I could not find them anywhere. I looked for them for about 15 minutes with no results. I tried to call them and no answer. I was distraught and confused and just wanted to go home. I decided to drive. I was picked up for speeding and then arrested for a dui. My breath test was .13

My first and second dui's were in Iowa in 2003. My first was done as a difered judgement. I got 6 months in county. There is a female that just got out of a 3rd and then got charged with one. She got 3 months. South Dakota reconized my first and second. Is there anything I can do to get time reduced. Need a good lawyer that knows and or licensed in Iowa. My lawyer didn't do hardly anything for me. Also I am a 16 year member of the military and verteran of foreign war.
