How to Get Your Driver's License Back After a North Dakota DUI Conviction
If you have been convicted of a DUI in North Dakota, then you will be given a driver’s license suspension or revocation. If your driver’s license is suspended, you can get your driving privileges back at the end of the period by paying a reinstatement fee. If your driver’s license is revoked, your driver’s license was effectively cancelled, and you will have re-apply for a new driver’s license at the end of your revocation period.
Procedure for Driver’s License Reinstatement after Suspension
After your suspension period is over, your license is automatically renewed after you pay the $100 reinstatement fee. You can do so online at the North Dakota Department of Transportation website by entering your name, date of birth, and driver ID. You can pay via credit or debit, and it is recommended that you print the receipt at the end of the process.
Procedure for Driver’s License Reinstatement after Revocation
If your license was revoked, you will have to pass the same written and road exams that a first-time driver goes through. You will also face board review. Also, if you have been arrested 4 times or more for a DUI, you need to provide proof that you participated in the mandatory alcohol treatment programs.
Temporary Restricted Driver’s License
In some cases, you may be eligible to drive before your suspension is over. To be considered for a temporary restricted driver’s license, you will need to show proof that you’re enrolled in a court-ordered drug program, have no convictions for 365 days, and get a letter of recommendation from your district court. Then you need to schedule a hearing with the Drivers License and Traffic Safety Division by emailing dlhearing@nd.gov. Include your full name, date of birth, and reason for writing. If you are approved, the temporary restricted driver’s license can only be used in the specific circumstances approved by the court, such as to and from work, school, or medical treatments.
Ignition Interlock Devices
As a condition of your driver’s license reinstatement or a temporary restricted driver’s license, the court may order that you have an ignition interlock device installed on your vehicle for a period of time. If this is the case for you, you will be responsible for the cost of installation and maintenance of the device. It works by requiring that you pass a breathalyzer test before your car’s engine will start. Then, as you drive, it will ask you to pass breathalyzer tests periodically and sound an alarm if you fail. Then you will have to pull over and turn off the car to get the alarm to stop.
SR-22 Insurance Forms
In many cases, you will need to show proof of financial responsibility before the DOT will reinstate your driver’s license. You will need to meet the minimum amount of coverage required by the state for your DUI case. Your insurance company can help you to update your insurance coverage and then send the SR-22 filing to the state. The SR-22 must be maintained for a minimum of 12 months, or your driver’s license will be suspended or revoked again.
