My prior arrest for dui was over 20 yrs ago. I was arrested last night after I contacted the police to file an accident report after I backed in to a tree branch and broke the back window in my mini van at the hotel I was staying at. I was not driving or in my vehicle when the arrest was made. I drank after the accident not thinking that I would call the police and file a report. After looking at the damage I decided that I should file a report for my insurance company. I did not think I would be in trouble since I was not planning on driving anywhere else. There was no damage to anything other than my van. I did admit to the police officer that I had had 2 beers earlier in the evening.

I parked my car in front of my house, took the keys out of the iginition and a police car came behind me and said that my lamp for the license plate was out. Then he asked me to do field sobriety tests which I couldn't perform even if I didn't have a drink. Then he gave me a breathelizer test that didn't work. He arrested me and brought me to the precinct. Where they took another breathelizer test. He also checked that I had my motor running when my car was off when he pulled up.

I woke up at 0730 on the morning of the 10th of December, 2011. I went to CrossFit in Clifton Park at 1100. At around 1230, I left CrossFit and drove to OhBar at 304 Lark Street, Albany NY. I remember having 1 beer and a double shot of Jameson whiskey. After the drinks I went outside to participate in the Santa Sprint. After the run, I went to another bar down the street with some friends. After we finished singing some songs, I went to my vehicle to drive home. Along the way, I must have gotten tired. I pulled over and went to sleep. I was awoken by the police and blew a 0.13 BAC. I did not have any breakfast or lunch, I wasn't hungry. I had slept approximately 5.5 hours the night before.

I was on my way to my neurologist appt, about 3 PM on 7/21/2011. I was stopped by the police because apparently two citizens saw me crossing the yellows. I was only reaching in my pocketbook for something to eat because I am diabetic (my pocketbook was was way down in passenger foot area. I was going around curves & my steering wheel was seeming very loose to me. When pulled over I was given a field sobriety test & & breathalyzer. They arrested me saying I blew a .21 which TOTALLY SHOCKED ME!!! I've been to court three times now & know for a fact the judge & appointed Public Defender were immediately prejudiced against me. I've been looking for s REAL DEFENSE Attorney ever since.

Summary:From a misdemenor to a felonyCase description:This happened in Yulan, NY, where my son lived at the time (he is now with his us his parents in Westchester county). He had a suspended license and drove a car only a short distance and was caught by the town police officer- this case does not involve drinking or drugs. He was first told it is a misdemeanor. He would be fined and perhaps serve several days in jail. When they got his rap sheet the prosecutor wants to raise it to a felony saying NY state law allows this because of his history. His history is not good dwi, served 9 months and at a younger age 2 times. He never spoke to the legal aid lawyer, cannot contact him- calls never returned. He has tried to improve himself was to move near public transportation and work on getting back to work in NYC. I have been driving him up to the Barryville court they mentioned years in jail. I am his father and willing to pay for an attorney

My son got arrested in front of our house. The officer said they have him on film leaving a grocery store parking lot. He supposedly hit a car and a pole, but there was no damage on the car. This is his 2nd dwi. He is only 23 and I am worried about a felony charge and cannot afford a lawyer. The first one wiped out our savings.

I was followed by the cops for three blocks before being pulled over and ask to do a breathalizer test and arrested a half block form my home when I ask why they pulled me over they said they saw me wave to my friends in front the bar I did not swerver run the light nor was I visibly drunk. I did have some beers I admit they never said how much I blew the first time then when I got to the Police Station it said 1.5% . Ihad a dui when I visited from Florida in 1998 how is that going to affect me? I was offered a deal to pay a fine do the class but I will have a criminal record against me which I turned down should I go to trial or accept the plea

Ihave a dui for ny state from 1997 right know i cannot get my MD drivers licence due to this,what can i do? I have no way to get to NY to find out how to handle this promblem. Iam sure there is a state of limitation on this of 7 yrs but the court says i must appearis there any way not to appear and get this taken care of, with out having to take a bus to NY.
