First time DUI Offense
A first time offense in Montana is charged a fine between $300 up to $1000, along with a minimum of 24 hours jail up to 6 months. The offenders license is suspended for 6 months.
Second time DUI Offense
A second offense in Montana is charged between $600 up to $1000, along with minimum 7 days of jail up to 6 months. The offenders license is suspended for 1 year, followed by ignition interlock device and a drug assessment and treatment program.
Third time DUI Offense
A third DUI offense in Montana is charged between $1000 up to $5000 with minimum 30 days jail up to 1 year. The offenders drivers license is suspended for a year, followed by ignition interlock device and a drug / chemical treatment and assessment program.
Fourth DUI Offense
A fourth DUI offense is considered a felony, and charged a fine between $1000 up to $10000, along with jail of up to 5 years. The offender can appeal for a probation, which has to be met by following a drug treatment program, abstinence from alcohol, agreeing to random drug/alcohol testing and several other conditions. Penalties for excessive alcohol level
In Montana, any one caught with a blood alcohol level of more than 0.08% is charged with DUI. The allowed limit for commercial drivers is 0.04%.
A first time offense for excessive alcohol is fined between $300 up to $1000 and the offender is jailed for a maximum of 10 days.
A second offense is fined between $600 up to $1000 and jailed between 5 days to a maximum of 30 days.
Third time excessive alcohol offense is fined $1000 up to $5000 and the offender is jailed between 10 days to 6 months.
