I was convicted of dui/other. The test were conducted, but they keep making me go to court. I have to go for a third time in January because they say the test results will be back. I arrested and was free in less than 30 minutes and was told to drive home as if they knew I was sober. I never went to a cell. prior to that, I have never had a speeding ticket. I was also charged with littering for spitting out a piece of gum after I was told to get rid of it.

I was 2 blicks from where I was going but he met me on scene to get my car. Now I have no Drivers Licensa and have to have them very often. I know what that machine said but I wasnt drunk. got a d.u.i. back in 2004 in corinth,ms. and convicted. in jan. of 2010 i was diagnosed with type 2 diabetes. in feb. of 2011 i was pulled over by booneville,ms. police dpt. and charged with reckless driving and second offense d.u.i. my questions are: how can i be charged with d.u.i. when it was my sugar dropped so low that it appeared i was under the influence and how can it be second offense when they go off your record after 5 years?

I was stopped and searched and arrested. The officer said he stopped me for improper lane change. Is that a law in MS? What is an improper lane change and is the a legal to stop a car in MS. I was told by an attorney that I could get the evidence suppressed because of the reason I was stopped. Improper Lane Change does not exist in MS.True or Not?

I was stopped and given a breath test at the car. My understanding is that someone called the sheriff dept about my driving.. From there I was taken to the jail in Liberty, MS. They say that I refused the breath test there. Was kept over night until I was let out on bond.

Was pulled over for allegedly not stopping at a stop sign. Once pulled over I was asked to perform a breath test and the result was a 0.08. I believe, including the other 4 passengers in my ride that I did infact stop, but I/we believe I was stopped because it was an officer that I did pull out in front of which happened to be right in front of a bar(which I thought could be grounds for entrapment). Also, I believe with my breath test result being at 0.08 that leaves room for error that I was actually under the legal limit of 0.08, given the fact these machines are not 100% correct.

I had been drinking earlier in the day, I probably consumed a 6 pack all in all. A couple of hours after finishing my last drink I and a friend decided to see if the store right down the road was still open (around midnight). I just moved into the area, and the store was less than a mile down the road. The store was closed and we left. I have bad night vision; the store is located on top of a hill and the ramp down to the road was obscured in shadows. I turned a little too early and high centered my car in a ditch. My friend and I decided to walk home and get his truck, to see if we could pull the car out instead of calling for a wrecker. Less than a half mile down the road a police officer comes down with his lights on and asks us what the problem is. We tell him, and he asks for our licenses. We offer him our licenses and he takes us back to the scene to figure out the story. We are there for a short time and a Mississippi State Highway Patrol shows up. As soon a s hegets there he asks me to submit to a breath test for alcohol. I do so, as I was pretty sure that after those hours I would not be over the legal limit. After I do so, he asks me to come to the station to take a further test. At this point I know something is up; but I submit and get to the station. The machine gives me a bac of .08 and the result is a dui charge and a night in jail. I bail myself out the next morning and my bond agent is kind enough to take me home.

The officer said he pulled me over for passing to close to where he was parked.I had been assulted kicked in my face and head and was bleeding profusely from a laceration in my chin and was disorientated and concerned over my condition trying to find a e.r. to get medical attention.the officer told me if i submitted to a breathilizer test i would not be arrested and allowed to go to the e.r. for treatment if i refused i would be arrested and brought to jail.I submitted tothe test was issued a dui and transported to the e.r. where i received several stitches in my chin and was checked by doctors and released.The only test performed was the mobile breathilizer at the site of which i don't even know the results as i said i had been kicked in the face and head and was very disoriented and upset over my condition.Does the circumstances and the lack of proper testing give me a good chance to get the dui dropped or plead down?Thank you for your time and knowlede.
