How to Get Your Driver's License Back After a Massachusetts DUI Conviction

If you fail a breathalyzer test in the state of Massachusetts, your driver’s license will be suspended for 30 days immediately. If you are then convicted of a DUI, which is called an OUI in Massachusetts for Operating Under the Influence, your driver’s license will be suspended for one year up to a lifetime depending on how many past DUI convictions you have. They will take into account DUI convictions you had in other states as well. If you are able to get your driver’s license reinstated, you will have to follow certain steps.

Steps to Getting Your Massachusetts Driver’s License Reinstated

After your suspension period, you will have to appear for a hearing at an RMV Hearing Site. Call 617-351-7200 to find out more, or visit the Massachusetts Department of Transportation website to see locations, date, and times that suspensions hearings are held.

You will also need to pay a reinstatement fee, which range from $50.00 and $1,200 depending on the offense. You also must have completed all the requirements mandated by the court for your conviction, such as jail time, fines, and attendance at a state-approved alcohol education program.

If this is your second or subsequent OUI conviction or Alcohol and Drug Program assignment, you will be required to install an Ignition Interlock Device on your car.

Eligibility for a Hardship Driver’s License in Massachusetts

Under certain circumstances, you may be eligible for a hardship license before you suspension period is complete. You will need to attend a hearing at an RMV Hearing Site. You can see the hardship criteria form which lists the requirements you must met in order to qualify. For example, there can be no evidence that you operated a vehicle since your driver’s license was revoked, and you must have served a minimum sentence for driver’s license revocation listed on the form. Even if you meet the criteria listed, the issuance of the hardship driver’s license is at the discretion of the RMV.

The Ignition Interlock Device Requirement

If you are required to install an ignition interlock device, you will be responsible for the cost of installation and maintenance. It is likely that it will be required for 2 years after the full reinstatement of your driver’s license, and if you are granted a hardship driver’s license, it will also be required for that period of time. Any attempt to tamper with or remove the ignition interlock device can result in your driver’s license being suspended again.
