BAC was .085.. This is my first case ever (I have never received a ticket or any type of traffic violation). I have already met with the judge though and have received 30 days of no driving at all and 60 days of hardship license. I hadn't had anything to drink within the past hour (except water) of being arrested and I had drank just one drink!

My passenger could not find his ID so I asked the civilian gate guard if I could turn around and find it offpost. He asked me to step out of the vehicle and open my trunk. A military police officer then conducted a field sobriety test on me, which I passed. They then said we were free to go. The officer then asked me questions. Charge 1: operation mtr vehicle u/ influence alc/ drugs/ etc. .08 - 1st offAbove subject was found passed out in floor board of passenger side of car. Vehicle was in the middle of alben Barkley road. Subject vomited in drivers seat and thought she was in the stars (local bar) paling lot sleeping. Subject smelled.of alcoholic beverage. Subject stated That she was driving the vehicle. Keys were on possession. Subject taken to wbh (western babtist hospital) and cited. Snr#11-022033This is the charges and post-arest complaint section of the Commonwealth of Kentucky uniform citation. It contains 1 charge. Violation code - 02108 statute/order. - 189A.010(5A)I fell asleep in my car at a business next to the bar waiting on a cop to move because they were blocking me in. The cop was dealing with someone unrelated to me, but wouldn't move to let me go. I woke up in my car sometime later when cop found my car. I don't have any knowledge of having driven my vehicle. The keys were found in my car but not in the ignition. I don't know if I can actually be charged with a dui if I wasn't found driving my car or with keys in the ignition. I don't yet know the results of the blood test. But I only had two beers and a mixed drink. I arrived at the bar before 12:30pm and the bar closed at 3:00 am. I was found at 4:44 by the police officer. I don't know how I could have been that intoxicated unless someone drugged me. But again, I haven't received the results of the blood test. I would like to know what options I have, if any, to contest this citation.
