In October 2008, my girlfriend was convicted of an OMVI in Indiana. This was her 3rd dui offense and therefore, she received a Class D Felony. It has been more than 3 years and she is off parole and served all the requirements of her punishment. From what I have read, it is impossible to get this expunged, but after 8 years, she can apply to have the felony removed from her record that employers would see during background checks. For now, we are looking to have it reduced so that she can find a job much easier. We would like to know if and when it is possible to try to get this reduced to a Class A misdemeanor.

Was pulled over by state trooper at 1:30 AM. I was given a field sobriety test and then a breath test. I was not told or shown the results of the test. The officer then explained the chemical test to be administered at the station. I accepted to take the test. After taking this second breath test, I was told I would be spending the night there. Again I was not shown or told the results of the test. Also I never was read my rights the entire time.

pulled over for speeding by a state trooper. Passed eye test, stepped on foot walking straight line due to sprained feet which I was in ER for 2 weeks prior with documentation, they said I refused Breathalyzer after failing to successfully breath non-stop twice. I was sober and on my way to get allergy medicine from an allergic reaction to a cat that was at the house I was at. I had my friend who clearly didn't look pregnant at the time and the officer had her do ONLY the eye test and took her word for the pregnancy then allowed her to take my vehicle with only a permit and not other drivers. I've never been in trouble in my life so I was nervous and did everything the officer told me without objecting when I knew I was sober. The Bmv has suspended my license for the failure to submit a Breathalyzer. I attended my first court date November 7, 2011 and was given a continuance to hire a lawyer. January 9, 2012 at 1:15pm is my next court date.

10 yrs ago I had a dui. On October 1, 2011 I had been drinking. I then decided I needed to go to bed. I took my Ambien so I could sleep. When I woke up, I was in jail. I was told that I actually drove to some address out in the country(which I don't remember) and when the oficer tried to stop me, I went to pull over and just wrecked. I was still asleep the entire time. A month or so ago, I cooked an entire meal while still asleep. The next morning I thought someone had broken in my home. I know that the drinking didn't help, but even at my worst drinking episode I would never drink and drive. I am absolutely sure that the the side effects of the Ambien caused me to sleep walk. I would never now dring and drive.

On early Sunday morning of October 16, 2011 I was in a wreck after falling asleep at the wheel of my vehicle. Fortunately, no one (including myself) was injured in the wreck. But, I had been drinking that evening with some girlfriends and was charged with an OWI, OWI-Endangerment, and Public Intoxication. I do not know what my BAC was and no one including the nurse who conducted the blood test at Riverside Hospital informed me of this information. Additionally, this is the first time I have ever been arrested for anything. I am absolutely beside myself right now, as I have a young son (he is 3 years old) and just started a new job in September working as a healthcare recruiter. I know it was not responsible to be drinking and operating my vehicle, but the cause of the crash was not the alcohol, it was my extreme exhaustion from working a 60 hour week at a new job and having a young child. However, I understand that is not how the law looks at this and it won't be looked at th is way.I can assure you I am a very responsible person and nothing like this has ever happened to me. I just don't know what to do at this point, but I know from talking to my parents, best friend whose family are all attorneys in Lafayette and other friends who are attorneys that this is the first step. My initial cour tdate is set for Wednesday, October 26th at 1:15 pm in Noblesville. I look forward to your response. Kind regards,
