A first time offense in any 5 year period (ex: 2003-2008) is charged $1,000 as fine along with minimum of 2 days jail to a maximum of 6 months, based on the alcohol evaluation level. Their drivers license may be suspended for a minimum of 30 days up to 180 days, especially under a refusal for breath or blood testing.

If you have been charged with DUI, it is important that you request a court hearing within 7 days of the being found guilty of DUI to reduce the suspension of your driving privileges. Failing to do so will result in an absolute suspension of your driving privileges for a minimum of 30 days and restricted privileges for a minimum of 60 days, whether or not you are found guilty of DUI after the hearing.

Second Offense DUI in 10 years

A second DUI offense in Idaho within 10 years is fined $2000, along with mandatory minimum 10 days of jail, which can be up to 1 year. The drivers license is also suspended for a minimum of 1 year after release, which means that the driver has no driving privileges at all. The driver will also have to install an ignition interlock after 1 year license suspension is over.

Third Offense DUI in 10 years

A third offense is charged up to $5000 along with a minimum of mandatory 30 days prison, which can be sentenced up to 10 years, depending on the judge’s decision. The drivers license is suspended for a minimum of 1 year after release, after which the driver will have to install an ignition interlock device. To continue to drive at this point is going to be near impossible.

BAC level 0.20% or higher

If you are caught with Blood Alcohol Content of more than 0.20%, you will be charged a fine of up to $2000, along with mandatory jail of minimum 10 days up to 1 year. Your licence will also be suspended for 1 year after release, with no driving privileges at all.

Idaho Drunk Driving and/or drug (drugged driving) for Minors under 21 years of age

First time DUI offenders under the age of 21 years are fined up to $1000. Their license is also suspended for a year, after which the offender can reapply for a restricted permit after 90 days.

Second time DUI offenders in 5 years will be fined anywhere between $500 up to $2000. They are sentenced to mandatory jail of minimum 5 days, up to 30 days along with license suspension of up to 2 years, followed by license suspension of 1 year. Other penalties include installation of an ignition interlock device after the 1 year suspension period. If you are arrested for being impaired by drugs, or if you refuse a chemical test, or there are accidents involved, this is where enforcement of additional penalties can apply, requiring a large bail amount, among other items.

Third time Idaho DUI offense in 5 years is charged a minimum fine of $1000 up to $2000. The driver is sentenced to minimum mandatory jail of 10 days up to 6 months, followed by a mandatory 1 year suspension of driving privileges or until the driver turns 21 years old. Once the suspension period is over, the offender has to install an ignition interlock device on the vehicle and also take an alcohol treatment and evaluation program.
